Notice of Land Use Board Special Meeting

NOTICE IS HEREBY GIVEN that the Land Use Board of Rockaway Borough will convene a special meeting on Wednesday, June 23, 2021 at 7:30 p.m. The meeting will be held at the Community Center, 21 Union Street, Rockaway, New Jersey. In recognition of the declared COVID-19 public health emergency, the Board is utilizing the Zoom meetings program to conduct meetings in compliance with the New Jersey Open Public Meetings Act. During the public hearing, any interested party, or its agent or attorney, will have an opportunity to view the hearing in its entirety and be heard by logging in to the virtual meeting.

The meeting is being held solely in order to hold public hearings, and potentially take action, in connection with the following application:
LUB#067A 74 West Main Street Urban Renewal Associate, LP which is a Whispering Woods settlement hearing pursuant to a settlement agreement between the Applicant and the Borough of Rockaway dated April 8, 2021. The application is Preliminary and Final Major Site Plan with a Minor Subdivision. The application and all related documents are available electronically two days prior to the meeting on the home page of the Borough’s website: https://www.rockawayborough.org.
The agenda to the extent known consists of the application of RPM Development Group (West Main Street Urban Renewal Associates) for a total of 70 units. 69 units for Senior Citizen Affordable Housing and one Caretaker unit at West Main Street and Mt Pleasant Ave (Block 73 Lot 65) Rockaway, NJ. The hearing will be conducted pursuant to Whispering Woods v. Middletown Township 220 N.J. Super.161 (Law Div. 1987). The Board may also hear such other matters as may rightfully be brought before it.

The Land Use Board of The Borough of Rockaway on May 4, 2021 adopted a memorializing resolution. LUB#066 was granted a use variance relief and a waiver of site plan to use an existing building to conduct an automotive window tinting business. The applicant is Faber Properties, LLC. Hydrant Inspection and Flushing Program 2021

Public Notice from the Water Department:
On May 17, 2021 the Borough of Rockaway Water Department will begin its annual Hydrant Inspection and Flushing Program. The program is expected to run until June 21, 2021. Crews will be out during the hours of 8 pm and 11 pm Monday through Friday. This program is essential to maintaining the water system which involves us systematically opening fire hydrants to increase water flows, this allows the Borough to flush any minerals and deposits from the water mains. While flushing the system won’t interrupt your water service, when crews are working in your neighborhood you may notice a temporary drop in your water pressure or discolor water. This is normal and is not a health hazard. If this occurs, simply let your cold-water tap run until clear. Check for discolored water before using the washing machine or dishwasher. If water pressure or water volume seems low after flushing has been completed, check your faucet screens for trapped particles. Thank you in advance for your cooperation.

East Main Street Bridge Study

Morris County in coordination with the North Jersey Transportation Planning Authority (NJTPA) and the New Jersey Department of Transportation (NJDOT) are conducting an Local Concept Development study to determine appropriate improvements to the East Main Street Bridge, which crosses the Rockaway River in Rockaway Borough. The goal of this study is to address structural deficiencies.

Throughout the process, local officials, community stakeholders and the public will have an opportunity to provide comments and ask questions. Please visit eastmainstreetbridge.com for more information, to follow the project, and to fill out the Community Input Survey.

An online public information meeting was held on Thursday, March 18 to inform the public of the condition of the bridge and to solicit public input and comment towards the project purpose and need. The public is invited and encouraged to comment on the study.

Keep Fire Hydrants Clear of Snow

Please be reminded that, per Section 217-65.1 of the Code of the Borough of Rockaway, fire hydrants must be cleared within 24 hours.
Thank you for your cooperation.

§ 217-65.1 Clearance of fire hydrants. [Added 10-24-2019 by Ord. No. 21-19]

  1. The owner, tenant, occupant or other person having charge of any dwelling, store, building or lot within the Borough of Rockaway shall, within 24 hours after the cessation of every fall of snow, slush or sleet or the formation of ice upon a fire hydrant abutting any such dwelling, store, building or lot, cause the snow, slush, sleet or ice to be removed from the fire hydrant to a three-foot clearance around the fire hydrant.
  2. If the party responsible for fire hydrant clearance under this section fails to perform the required clearance within the specified time, the Borough, or any department thereof, may perform the clearance and bill the responsible party no more than $75 for this service.
  3. Any monies collected by the Borough, or any department thereof, to perform the required fire hydrant clearance, shall be deposited into the Borough Fire Department's training fund account to be used for training and training-related purchases.

Notice of Contract

RESOLUTION 11-21: AUTHORIZATION TO RETAIN PROFESSIONAL SERVICES (MUNICIPAL ATTORNEY, MUNICIPAL AUDITOR, AND MUNICIPAL PLANNER)

WHEREAS, N.J.S.A. 40A:11-1 et. seq., known as the Local Public Contracts Law, requires that all contracts or agreements for the performance of any work, shall not be made or awarded unless public advertising for bids and bidding therefore is solicited; and

WHEREAS, N.J.S.A. 40A:11-5 provides that any contract or agreement may be made, negotiated or awarded without public advertising for bids and bidding therefore, if the subject matter thereof consists of professional services, are rendered or performed by a person authorized by law to practice a recognized profession; and

WHEREAS, the Borough of Rockaway has need for such professional services as municipal attorney, municipal auditor and municipal planner which said services will be performed by persons authorized by law to practice a recognized profession; and

WHEREAS, the Borough of Rockaway has a need to acquire the services of municipal attorney, municipal auditor and municipal planner as non-fair and open contracts without public advertising pursuant to the provisions of N.J.S.A. 19:44A-20.5; and

WHEREAS, the Borough of Rockaway Chief Financial Officer has determined and certified in writing that the value of the aforementioned contracts will exceed $17,500; and

WHEREAS, the certification by the Borough of Rockaway Chief Financial Officer that funds are available is contingent upon the adoption of the 2021 temporary budget and the 2021 municipal budget;

WHEREAS, the anticipated terms of the contracts for municipal attorney, municipal auditor and municipal planner shall be one year; and

WHEREAS, Bell & Shivas, P.C.; Nisivoccia LLP; and Topology NJ LLC have submitted proposals indicating they will provide the municipal attorney, municipal auditor and municipal planner services respectively for the Borough of Rockaway; and

WHEREAS, Bell & Shivas, P.C.; Nisivoccia LLP; and Topology NJ LLC have completed and submitted a Business Entity Disclosure Certification which certifies that they have not made any reportable contributions to a political or candidate committee in the Borough of Rockaway in the previous one year, and that the contract will prohibit them from making any reportable contributions through the term of their contracts.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Rockaway, County of Morris, New Jersey as follows:

  1. That in accordance with provisions of N.J.S.A. 40A:11-1, this Mayor and Council is hereby authorized to proceed with the awarding of contracts for the following enumerated services, without the advertising for and the receipt of bids for such work, inasmuch as they are professional services as set forth in said statute:
    a. Municipal Attorney (Bell & Shivas, P.C.)
    b. Municipal Auditor (Nisivoccia LLP)
    c. Municipal Planner (Topology NJ LLC)
  2. The Business Disclosure Entity Certification and the Determination of Value shall be available for inspection in the office of the Acting Borough Clerk.
  3. The Acting Clerk of this Borough is hereby authorized and directed to forthwith publish a copy of this resolution in the official newspaper of the Borough of Rockaway.

U.S. Environmental Protection Agency Reviews

The U.S. Environmental Protection Agency (EPA) is conducting its first Five-Year Review of the Rockaway Borough Wellfield Superfund Site located in Rockaway Borough, Morris County, New Jersey. This review seeks to confirm that the cleanup conducted at the site, which included:

  1. wellhead treatment of the borough supply wells;
  2. potentially responsible party groundwater extraction and treatment system;
  3. EPA-lead groundwater extraction and treatment system;
  4. potentially responsible party soil vapor extraction system; and
  5. EPA-lead soil vapor and extraction system to ensure the effectiveness of the remedy continues to be protective of public health and the environment and is functioning as designed.

Rockaway Borough Ordinance 12-20 was introduced and passed upon first reading at a meeting of the governing body of the Borough of Rockaway, in the County of Morris, State of New Jersey, held on Thursday, July 9, 2020 at the Rockaway Borough Community Center, 21-25 Union Street, Rockaway, New Jersey. It will be further considered for final passage, after public hearing thereon, at a meeting of the governing body to be held on Thursday, August 13, 2020 at 7:30 p.m. at the Rockaway Borough Community Center. During the week prior to and up to and including the date of such meeting, copies of the full ordinance will be available at no cost and during regular business hours, at the Clerk’s office located in the Municipal Building, 1 East Main Street, Rockaway Borough, New Jersey, for the members of the general public who shall request same. ORDINANCE DESCRIPTION: This ordinance authorizes the Borough of Rockaway, that, in the CY 2020 budget year, the final appropriations of the Borough of Rockaway shall be increased by 3.5%, amounting to $332,991.00, and that the CY 2020 municipal budget for the Borough of Rockaway be approved and adopted in accordance with this ordinance. Any amount authorized that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years.
