Foxs Lake Dam Rehabilitation

Notice is hereby given that sealed bids will be received by the Borough of Rockaway in the County of Morris, State of New Jersey, at the Community Center, located at 21-25 Union Street, Rockaway, New Jersey, 07866 on June 10, 2020, at 9:00 a.m., prevailing time, and at that time and place publicly opened and read for the Foxs Lake Dam Rehabilitation. Notice is also hereby given that, due to the Coronavirus Health Emergency, appropriate social distancing requirements must be adhered to.

The work to be performed includes the furnishing of all labor, materials and equipment necessary to complete the work as shown on the drawings and described in the specifications. The work in this contract includes the construction of one reinforced concrete spillway, approximately 750 cubic yards of gabion baskets, approximately 225 cubic yards of reno mattress, approximately 820 square yards of rip rap slope protection, construction of new drainage pipes and structures, and other incidental work. An Alternate Bid will also be received for approximately 2500 cubic yards of Lake Dredging and Sediment Disposal. All bidders must bid on the alternate bid. The Governing Body, if electing to award, will award the base bid, plus or without the alternate bid. The alternate bid will not be awarded separately and will only be awarded in combination with the base bid.

Notice is also given that Borough Hall and the office of the Borough Engineer may be closed to the public during the Coronavirus Health Emergency. Contract Documents and Plans can be viewed on the Borough website at Contract Documents, Plans and Proposal Forms will be sent by overnight delivery service only to Prospective Bidders who submit payment of $70.00, payable to Ferriero Engineering, Inc., said sum not refundable, beginning on May 13, 2020. Payment for the bid documents must be sent to Ferriero Engineering, Inc at 180 Main Street, Chester, NJ 07930, (908) 879-6209 by a delivery service that provides certification of delivery to the sender. Any requests send by US Postal Service are to be sent by certified mail to Ferriero Engineering, Inc., PO Box 571, Chester, NJ 07930. The payment shall be accompanied by information that provides the bidders name, return address, email address and phone number to allow bid documents to be sent to the bidder by express delivery service. Due to limited office hours, payment for bid document must be received by the close of business, 5:00 p.m., on Tuesday June 2, 2020. The payment for bid documents includes the cost to send the documents to the prospective bidder.

Notice is also hereby given that bid documents will be sent out to prospective bidders via overnight delivery service only on certain dates due to the Coronavirus Health Emergency and subsequent limited office hours.

Each bid must be made on the prescribed forms furnished with the Contract Drawings and Specifications, including Proposal Form, Schedule of Prices, Bid Bond Guarantee, Site Inspection Affidavit, Acknowledgment of Receipt of Changes to Bid Documents, Stockholder Statement of Ownership, Non-Collusion Affidavit, Consent to Investigation, Bidder's Qualification Form, NJ Business Registration Certificate, Public Works Contractor Registration Certificate, List of Subcontractors, Plan and Equipment Questionnaire, Disclosure of Investment Activities in Iran, and Bid Opening Checklist.

Bid must be accompanied by a Consent of Surety and a Certified Check, Cashier's Check or Bid Bond of not less than ten (10%) percent of the amount bid, and not to exceed $20,000.00. Bids may be submitted by mail, but will be considered only if received on or before such date and time.

State of New Jersey Labor prevailing wage regulations and Standards Provisions will apply. Attention is called to the fact that the Contractor must ensure that employees and applicants for employment are not discriminated against because of their age, race, creed, color, national origin, ancestry, marital status, affectional or sexual orientation, gender identity or expression, disability, nationality or sex.

Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27, and PL 1977, c.33. Bidders are required to comply with the New Jersey Business Registration Certificate Law, P.L. 2004, c. 57. Bidders are required to comply with the Public Works Contractor Registration Act, P.L. 1999, c. 238.

The Borough reserves the right to reject any and all bids, to waive immaterial informalities, and/or to accept the bid which, in the opinion of the Borough, will be in the best interest of the Borough, all in accordance with the New Jersey Public Contract Law N.J.S.A. 40A:11-1 et. seq.
